N E W C O N S T R U C T I O N Essentials for building a new home If you are an owner of a real estate or you have bought one and you want to build your own house, this means that you are an investor, financing the building of a new home. You need to know that the activity on the layout of the territory of the corresponding municipality is carried out by the Municipality councilors and the mayors of the municipalities, according to the recently passed Territory Layout Law (TLL) from 26.04.2002. Construction according to TLL is the situating and building of edifices, structures, networks and equipment on real estates. In accordance with this law, the Chief Architect of the municipality conducts and controls the actions on the territory layout according to the rights granted to him by law.
The first thing that you need is: 1.PLAN (VISA) FOR PROJECTION – The demand for issuing of plan (visa) for projection is made by way of a written application from the person, who has the right to build in the real estate. Within a period of 14 days after the declaration is submitted, the chief architect of the municipality issues the plan for projection. The visa is a copy of the current comprehensive layout plan (CLP) with a specified location, method of construction, purpose of the project and the necessary utmost admissible indices, measures and distances for construction. The visa also includes architectural-layout, ecological, infrastructural and other requirements for using water, energy and other resources, as well as the necessary documents, which the investor should submit for issuing a building permission. 2.PREPARING BLUEPRINTS: this can be worked out by the building company or another designer team, chosen by yourself. The blueprint should include an architectural part, a construction part, electric, water, sewer, heating and ventilation systems. Each part should include explanatory notes, sketches and calculations. 3.APPROVAL OF THE BLUEPRINTS: the chief architect of the municipality approves the architectural part after coordinating the other parts of the project with competent experts of the municipal administration. The administrative bodies, the officials of which have the power after the Territory Layout Law to approve the projects, provide by virtue of their offices their position regarding the requirements for: The administrative agencies, the officials of which have the right according to the Territory Layout Law to accept the projects, to provide competent opinion about the requirements for : preserving the environment for constructions, where abiding by such requirements is necessary; sanitary control, where this is demanded by a normative deed; technical safety and reliability of equipment under state supervision with an increased point of danger; buildings in a landslide regions; certain kinds of buildings, according to the normative deeds. fire and breakdown security, when this is demanded with a normative deed; Approval or rejection and return for remaking is done in one month term from the date of the application. For the services of viewing and approval of the projects, the administrative officials charge fees according to the State Duty Law and the Local Taxations Law. After you complete: a/ documents for ownership; b/ plan (visa) for project; c/ рpproved project – 3 copies d/ the necessary permissions from the respective offices, depending on the type, specification and the location of the construction, requiring documents prepared according to normative deeds. What is submitted is: 4.A DECLARATION FOR BUILDING PERMISSION: The building permission is issued within a period of 7 days after the written declaration is submitted by the real estate owner. вhe building permission includes all factual and legal grounds for its issuing, the terms, relevant to the execution of the building. The building permission or its refusal could be submitted within 14 days from the notice of issuing of the respective deed. A certified copy of the approved project is also applied a certified copy to the building permission. The building permission loses its legal effect if the building has not been launched within 3 years from its issuing or if within a period of 5 years from the issuing the rough work is not completed, including the roof of the building. This is specified in a written form by the official who has issued it. The next stage is: 5. BEGINNING OF THE BUILDING: Beginning of the building is considered the day when the protocol for opening a building site and determining the building line and level is prepared. This is done in a written declaration by the investor to the mayor of the municipality (region) according to the issued building permission. Main participants in the building are the investor, the designer and the builder. The relations between the participants in the building are settled freely by contracts, by observing the Territory Layout Law and the other normative acts. The guarantee period of building and assembly works are defined by way of building contracts . The builder is responsible for the realization of the building and assembly works and for their compliance with the project and the building rules and norms. After the final completion of the building process, the investor and the builder prepare: 6.Establishing Act: with which they certify that the building process has been carried out in accordance with the executive documentation, the technical requirements, the requirements for healthy and safe labour conditions, and the terms of the contract. With this act is also carried out the transfer of the building from the builder to the investor. In case of appropriate organization, many of these stages can merge in time and the realization of the project can be carried out within a period of several months.
